Terms of Use

These Terms of Use ("Terms") govern your use of this website and any mobile applications published by Varsha Jadhav ("I", "me", or "my"), an individual independent iOS developer based in India (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, please don't use the Services.

1.Scope & per-app terms

These Terms apply to my website and apps generally. An individual app may have additional terms shown in the app or on its App Store listing; where those differ, the app-specific terms control for that app. At present I have not yet published any apps, so these Terms are provided in advance to make the rules clear before any release.

2.Acceptance & eligibility

By downloading or using the Services you confirm that you can form a binding agreement and that you are old enough to do so in your country. If you are using the Services on behalf of someone else, you confirm you are authorised to accept these Terms for them.

3.Licence to use my apps

I grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use my apps on Apple devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and Apple's App Store Terms of Service.

4.Things you agree not to do

• Copy, modify, distribute, sell, or rent any part of the Services.
• Reverse-engineer or attempt to extract the source code, except where the law expressly permits.
• Use the Services for any unlawful, harmful, or abusive purpose.
• Interfere with, disrupt, or attempt to gain unauthorised access to the Services.
• Access the Services through automated means in a way that places an unreasonable load.

5.Technical requirements

Apps may require a compatible Apple device and a supported version of iOS or iPadOS. You are responsible for your device, your internet connection, and any related costs from your carrier or provider.

6.Purchases & subscriptions

If an app offers paid features or subscriptions, purchases are processed by Apple through the App Store and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and you can manage or cancel them in your Apple account settings. Refunds are handled by Apple under its policies.

7.Your content

Any content you create or store using an app remains yours. To the extent an app needs to process that content to provide its features (for example, syncing it to your iCloud), you grant me the limited permission necessary to do so. I claim no ownership of your content.

8.Third-party services

The Services rely on third parties such as Apple. Those services are governed by their own terms and privacy policies, and I am not responsible for them. Your use of them is at your own discretion.

9.Updates & support

I may release updates to improve, fix, or change the Services, and some updates may be required for continued use. Support is offered on a best-effort basis by email at varshakjadhav@gmail.com; I aim to respond promptly but cannot guarantee a specific response time or that every issue can be resolved.

10.Disclaimer of warranties

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. I do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. This does not affect any warranties that cannot be excluded under applicable law.

11.Limitation of liability

To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, or consequential damages, or any loss of data or profits, arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited by law, including your mandatory statutory consumer rights.

12.Consumer rights

If you are a consumer, you have statutory rights that apply regardless of these Terms, and nothing here removes or reduces them. Where local law gives you a right to cancel, return, or obtain a remedy, that right continues to apply.

13.Termination

You may stop using the Services at any time by deleting the app. I may suspend or end your access if you materially breach these Terms or where required by law. Provisions that by their nature should survive (such as disclaimers and liability limits) will continue to apply.

14.Governing law

These Terms are governed by the laws of India, and the courts of India will have jurisdiction over any disputes, without affecting any mandatory consumer protections available to you in your country of residence.

15.Changes to these Terms

I may update these Terms from time to time. When I do, I'll revise the "Last updated" date above. Continued use of the Services after changes take effect means you accept the updated Terms.
